Wage and hour case in which different entities owned and operated the business at various times. At issue was Plaintiff’s standing to bring suit against the last owner due to her termination the week of the sale of the business.
Defendants hired a private pilot on a per diem basis as needed. The pilot was in an auto accident while he was in route to the airport after flying the plane’s owners to LA the day before. Plaintiff brought suit against both the pilot and the owners of the plane. At issue was whether the pilot was an employee or an independent contractor and whether the car accident occurred during the course and scope of the pilot’s employment.
Plaintiffs allege Defendants misclassified them as independent contractors, failed to provide proper meal and rest breaks, and failed to pay contracted omissions.
